Terms and Conditions (T&Cs) – Majoma Safari Ltd.

1. Company Details / Contracting Parties

Majoma Safari Ltd. (hereinafter referred to as “Majoma Safari”) is a company duly incorporated and operating in the Republic of South Africa and provides the organisation and/or brokerage of hunting safaris and wildlife safaris.

These Terms and Conditions apply to consumers as defined under the Consumer Protection Act (CPA) as well as to business customers, unless expressly stated otherwise.

2. Nature of the Contract

Depending on the individual offer, Majoma Safari acts either as:

• Tour operator / organiser, or

• Agent / intermediary for third-party service providers (including hunting areas, professional hunters, accommodation providers, transport services).

The respective role of Majoma Safari is determined exclusively by the written offer and the concluded contract.

3. Conclusion of Contract

By signing the hunting or travel agreement, the client commissions Majoma Safari with the planning, organisation and/or brokerage of the booked hunting safari. By concluding the contract, the client confirms having read, understood and accepted these Terms and Conditions.

The contract may be cancelled subject to the cancellation terms stipulated in the individual agreement.

4. Client’s Duty to Cooperate

All documents required for the proper organisation of the safari (including but not limited to passport copies, firearm details, licences and permits) must be submitted no later than 30 days prior to departure, unless otherwise agreed in writing.

Failure to comply may result in additional costs, delays or cancellation charges, which shall be borne by the client.

5. Scope of Services

The scope of services is exclusively determined by the written offer and the contract based thereon. Any deviating arrangements or promises made by third parties or local partners are not binding on Majoma Safari.

6. Payment Terms

Payment terms are set out in the individual contract.

• A deposit of up to 25% of the estimated total price is payable upon conclusion of the contract.

• The balance is payable after completion of the hunt.

If the deposit is not paid in due time despite a granted grace period, Majoma Safari is entitled to withdraw from the contract. Any costs incurred shall be borne by the client.

7. Notice of Risk – Section 49 CPA

Important Notice – Risk Activity: Hunting safaris and wildlife safaris take place in free-roaming wilderness areas and constitute inherently hazardous activities as contemplated in Section 49 of the Consumer Protection Act.

Such risks include, without limitation:

• dangerous and unpredictable wildlife

• firearms and hunting activities

• rough terrain, weather and environmental conditions

• vehicles, aircraft and hunting infrastructure

By entering into this agreement, the client expressly acknowledges these risks and voluntarily accepts participation at their own risk.

8. Liability

Majoma Safari shall only be liable for damages caused by its wilful misconduct or gross negligence, as required under South African law.

Majoma Safari shall not be liable for:

• inherent hunting risks

• hunting or traffic accidents

• loss, damage or delay of baggage

• acts or omissions of third-party service providers

• events of force majeure, including but not limited to war, unrest, strikes or natural disasters

Liability for ordinary negligence is excluded to the extent permitted by law.

Nothing in these Terms excludes or limits liability for death or personal injury resulting from gross negligence or wilful misconduct.

9. Hunting Success and Trophies

No specific hunting success, trophy size or harvest is guaranteed. Failure to achieve a desired hunting result does not entitle the client to a reduction or refund of the price.

Trophies remain the property of the local hunting operator until full payment has been made. Majoma Safari’s responsibility for trophies ends upon delivery to the taxidermist.

10. Client Obligations

The client is solely responsible for:

• compliance with all applicable laws and regulations

• valid travel documents and permits

• taking out adequate international hunting liability insurance

The client must follow the instructions of the Professional Hunter at all times. Hunting under the influence of alcohol or drugs may result in immediate exclusion from the hunt.

11. Hunting Log

The hunting log constitutes the primary basis for the final invoice. It shall be completed in English and/or German and signed by the client.

12. Final Invoice

The final invoice is issued based on the signed hunting log and is payable immediately, either on site or after the client’s return.

13. Complaints

Any complaints must be reported immediately on site and, where possible, recorded in the hunting log. Written complaints must be submitted within 10 days after completion of the safari.

14. Cancellation by the Client

Consumers may cancel the contract subject to the agreed cancellation terms. Majoma Safari is entitled to charge a reasonable cancellation fee reflecting costs already incurred.

Business customers are not entitled to protection under the CPA.

15. Cancellation by Majoma Safari

Majoma Safari may cancel the contract if:

• force majeure renders the safari impossible

• the minimum number of participants is not reached

Payments already made will be refunded to the extent that no non-recoverable third-party costs have been incurred.

16. Early Termination

If the client terminates the safari early for reasons attributable to the client, no refund shall be granted for services already rendered.

17. Force Majeure

In the event of force majeure, each party shall bear its own costs incurred up to that point. Further claims are excluded.

18. Governing Law and Jurisdiction

This agreement is governed exclusively by the laws of the Republic of South Africa. Jurisdiction lies in South Africa, to the extent permitted by law.

Mandatory consumer rights under the Consumer Protection Act remain unaffected.

19. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
